SmartNest Terms and Conditions
Effective Date: April 6, 2026
1. Acceptance of Terms
By creating a SmartNest account or connecting a SmartNest device to your network, you agree to be bound by these Terms. If you do not agree, do not use the products and return them within the statutory withdrawal period.
2. Service Eligibility & Account Security
Age Requirement: You must be at least 18 years old to enter into this agreement.
Credentials: You are solely responsible for maintaining the confidentiality of your account keys and passwords.
Unique Passwords: Per 2026 security standards, you must define a unique, high-strength password during initial setup. "Admin/admin" or factory-default passwords are prohibited.
3. Software License & Updates
License: SmartNest grants you a non-exclusive, non-transferable license to use the embedded software solely for its intended purpose.
Mandatory Updates: You agree to install security updates promptly. SmartNest commits to providing security updates for at least five years from the date of purchase, as required by the latest Rules.
4. Safe Usage & Connectivity
Safety Protocols: Users must comply with ISO/IEC 15067-5:2026 safety frameworks. SmartNest is not liable for damages caused by "unsafe commands" triggered by third-party integrations or improper installation.
Interoperability: While we support certified devices, we do not guarantee 100% functionality when connected to non-certified third-party hubs.
5. Payments, Subscriptions & Cancellations
Withdrawal Right: For online purchases, a withdrawal button is available in your account dashboard. You may cancel distance contracts within 14 days without justification.
Automatic Renewals: Subscription services (e.g., Cloud Storage) renew automatically unless canceled at least 24 hours before the period ends.
6. Limitation of Liability
Indirect Losses: To the maximum extent permitted by law, SmartNest is not liable for indirect, incidental, or consequential damages, including loss of data or energy-saving profits.
Liability Cap: Our total liability for any claim is capped at the total amount paid by you for the specific product or service in question.
7. Dispute Resolution
Mediation: Before resorting to litigation, both parties agree to attempt a good-faith resolution through professional mediation.
Governing Law: These terms are governed by the laws of the jurisdiction in which the product was purchased.
